Late Paycheck as a Steel Worker

Employment as a steel worker is hard, physical work and most workers are tired when they have completed a day or week’s work and do not want to be bothered by a late paycheck. Some steel worker employers do not put their workers first and violate federal and state laws when it comes to paychecks. Late Paycheck Laws

If you have received a late paycheck or no paycheck at all you should check your state’s rules regarding this matter. You should also check federal late paycheck laws which can be found in the Fair Labor Standards Act (FLSA) and may not be the same as your state’s rules.

Typically, there are state and federal laws that rule that a steel worker’s employer must make regular payments to steel workers which should be in the employment agreement. Most steel workers are paid either weekly or each fortnight. If the employer fails to pay its steel workers wages on the specified day, then this is violating the law.

Examples of State Late Paycheck Laws

The agreement between the steel worker and employer sets the employment terms. This includes when wages are to be paid. Most California steel workers must be paid at least twice monthly.  An employer is required to establish a steel worker’s regular paydays before the first payment is made. Also, the employer is required to post a notice for all steelworkers to see which gives the details about the regular pay days including the time and place the paychecks are paid. Any wages earned between the 1st and 15th day of each month are required to be paid between the 16th and 26th day of that same month.

Alabama and South Carolina are two states which do not have any precise rules about when paychecks should be paid to steel workers. Employers in these states who employ more than 5 steel workers only need to give written notice to their steel workers about paydays.

Steps to Take When Your Paycheck is Late as a Steel Worker

If you have not received your paycheck on the expected date you should check the labor laws in your state. Most states expect steel workers to be paid weekly or at least fortnightly. If there appears to be a violation of state law, you should not hesitate but do the following:

  • Write to your employer asking for the payment to be made.
  • If your employer does not reply to your request, or simply does not pay what you are owed, you should file a complaint with your closest state Labor Department office.
  • If you are only owed a small amount you can file a claim with the small claims court.
  • You should not leave your job as your employer is not allowed to fire you for filing a late paycheck complaint.
